Terms and Conditions

Please read these terms and conditions ("terms") carefully before using the Survivalist Emergency Planner mobile app ("app", "service") on iOS, iPadOS or Android. The app is operated by ASF Interactive Limited ("us", "we", "our").

Conditions of use

By downloading or using the app, you confirm that you have read these terms and agree to them. If you do not agree, please stop using the app. We grant use of the app, its products and its services only to people who accept these terms.

If you downloaded the app from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. If you downloaded it from Google Play, the Google Play Terms of Service also apply. If those terms and these terms conflict, these terms apply as far as the law and the store rules allow.

Privacy policy

Before you continue using the app, please read our privacy policy. It explains what data we collect, which is very little.

Age

You must be at least 13 years old to use the app. If you are under 18, you may use it only with the permission and supervision of a parent or guardian, who accepts these terms on your behalf.

Important: emergency information disclaimer

The app helps you plan and prepare for emergencies. It is not an emergency service, and it does not replace one.

  • In an emergency, always contact your local emergency services first (for example 999 or 112 in the UK, or 911 in the US) and follow the instructions of the authorities.
  • The guides, plans, checklists and any other content in the app, including content we provide, are general information only. They are not medical, legal, safety or other professional advice, and may not suit your situation, location or local laws.
  • We work to keep the content accurate, but we do not guarantee that it is complete, correct or up to date.
  • The app may not be available when you need it, for example if your device is lost, damaged or out of battery, or if the app stops working. Do not rely on the app as your only source of emergency information. Keep printed or offline copies of anything critical.
  • You are responsible for your decisions and for the plans, supplies and expiry dates you record in the app.

Free and Pro plans

The app is available in two versions:

  • Free: you can keep up to 2 caches, 2 plans and 2 guides. Items that other people share with you and items you import count towards these limits. Sharing is not available.
  • Survivalist Pro: unlimited caches, plans and guides, plus encrypted sharing.

We may change which features are included in each plan. If a change removes a feature you paid for during your current subscription period, the change will apply only from your next renewal.

Subscriptions, payment and cancellation

Survivalist Pro is an auto-renewing subscription, available monthly or yearly. The price and length of each plan are shown in the app before you buy.

  • Payment is taken by Apple (from your Apple Account) or by Google (from your Google Play account) when you confirm the purchase. We never see or store your payment details.
  • Automatic renewal: your subscription renews automatically at the price and for the period shown, unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
  • Managing and cancelling: you can manage or cancel your subscription at any time in your Apple Account settings or in the Google Play app, under Subscriptions. If you cancel, you keep Pro until the end of the period you have already paid for. Deleting the app does not cancel your subscription.
  • Free trials: if we offer a free trial, any unused part of it ends when you buy a subscription.
  • Price changes: if we change the price, Apple or Google will tell you beforehand, and ask for your agreement where the law or the store rules require it.
  • Refunds are handled by Apple or Google under their own refund policies. We cannot issue refunds ourselves. To request one, go to reportaproblem.apple.com or to Google Play.
  • If your subscription ends, nothing is deleted: all your data stays on your device. If you have more items than the Free plan allows, you will need to delete some of them, or subscribe again, before you can open your caches, plans and guides or add new ones.

Your data and backups

The app has no user accounts. Everything you create is stored on your device. We have no access to it and cannot recover it for you.

Your data may be included in your device's own backups (iCloud Backup on iOS, or Google backup on Android) if you have turned those on. Those backups are provided by Apple or Google under their own terms. You are responsible for keeping backups of anything you do not want to lose.

Your content and sharing

You own the caches, plans, guides and other content you create in the app ("your content"). We do not claim any rights over it.

With Survivalist Pro you can share content as encrypted .survivalist files protected by a password you choose. When you share:

  • you are responsible for what you share and for who you share it with. Do not share content that is unlawful, harmful or infringes anyone else's rights;
  • we cannot recover a lost password and cannot decrypt shared files. If the password is lost, the file cannot be opened;
  • send the password to the recipient separately from the file.

Content that other people share with you belongs to them and is their responsibility, not ours. Check it before you rely on it.

Intellectual property

The app and the content we provide in it, including its design, text, guides, images, software, names and logos, belong to ASF Interactive Limited or our licensors, and are protected by copyright, trademark and other laws. We grant you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, for your own non-commercial use, under these terms and the store terms that apply.

You may not copy, modify, distribute, sell, reverse engineer or create derivative works from the app or our content, except where the law allows it. This does not limit your rights in your own content.

Third-party links and services

The app may contain links to websites and services we do not control, such as articles, links that you or other people add to plans and guides, and map apps. We are not responsible for their content, availability or privacy practices. Using them is at your own risk.

Changes to the app and to these terms

We may update, change or stop offering the app or any of its features.

We may change these terms from time to time. We will publish the new version on this page and update the "Last updated" date. If a change is significant, we will also let you know in the app or in the app's release notes. If you keep using the app after a change takes effect, you accept the new terms.

Ending these terms

You can stop using the app at any time by deleting it from your device. Remember to cancel any subscription separately (see above).

We may stop providing the app to you if you seriously or repeatedly break these terms.

Limitation of liability

The app is provided "as is" and "as available". As far as the law allows, we make no promises that it will be uninterrupted, error-free or fit for any particular purpose.

As far as the law allows, ASF Interactive Limited is not liable for:

  • any loss or damage that results from relying on the app or its content in an emergency, or from the app being unavailable;
  • loss of data stored on your device;
  • any indirect or consequential loss, or loss of profit, business or opportunity.

As far as the law allows, our total liability to you for anything related to the app is limited to the amount you paid for the app in the 12 months before the claim.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot legally be limited or excluded. Nothing in these terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 if you live in the UK. If you live outside the UK, you may also have consumer rights under your local law that these terms cannot override.

Indemnification

You agree to compensate ASF Interactive Limited for legal claims and costs that arise from your misuse of the app or your breach of these terms, for example from content you share. This applies only as far as the law allows, and only where the loss was caused by you.

Applicable law and disputes

These terms are governed by the law of England and Wales. Any dispute about them, or about the app, will be dealt with by the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts. If you live in another country, you may also have the right to bring proceedings in the courts of the country where you live.

If you have a problem with the app, please contact us first so that we can try to resolve it.

General

If any part of these terms is found to be invalid or unenforceable, the rest of the terms stay in effect. If we do not enforce a right straight away, we can still enforce it later. These terms, together with our privacy policy and the store terms mentioned above, are the whole agreement between you and us about the app, and replace any earlier version.
